Site Usage

1.1 By using Echo Melon AI, you agree that you are 18 years of age or older.

1.1.1 If a user is found to be under 18, the Echo Melon AI account will be deleted without prior notice.

1.2 Profiles made by users in its entirety including profile picture, username, and any profile decorations have to follow the site's ToS.

1.2.1 Bios, usernames, and profile decorations containing hateful and/or bigoted content is not tolerated and may result in a ban from the site at moderator's discretion.

1.2.2 Any direct links referring to sites with similar services are considered advertisements of competitors and are not allowed.

1.2.2.1 We do allow links leading to external sites unrelated to Echo Melon AI and its services such as your own content, portfolios, donations, and sites such as Carrd and Linktree.

1.2.2.2 Any profiles containing or leading to malicious content will be banned. This includes disturbing imagery displayed on the profile avatar or in its description.

1.3 By using the site or creating bots you agree that you have read and understood our Terms of Service. Failing to follow these rules will result in bots being forcefully privated, and in case of multiple violations of rules your profile will be banned from the site entirely.

1.4 Moderators and administrators of the site have the right to change and add rules to their discretion. It is up to the users to regularly check the rules to keep themselves updated.

1.4.1 Moderators will reserve the right to delete a bot that does not comply with the rules if it is not explicit or if it leads to doubt.

Character Creation

2.1 We do not allow bots including subjects of illegal nature on the site.

2.1.1 Incest; Any relations where the user and bot—or multiple characters in a bot—is suggested to be family related by blood and engaging in sexual or romantic activities.

2.1.2 Pedophilic themes and scenarios; Any bots containing or suggesting grooming or pedophilic relationships between an underage character and an adult character is strictly prohibited. Neither the user or the bot can be implied to be under the age of 18 if the setting is of NSFW nature.

2.1.3 Necrophilic themes and scenarios; Themes or scenarios where sexual relations or activity is being encouraged, performed, or described with dead bodies, be it animal, human or inhuman is strictly prohibited.

2.1.4 Bestiality; Echo Melon AI strictly prohibits any form of roleplay, content creation, or character that involves bestiality. This includes any sexual content with characters based on real, non-sapient animals.

2.1.4.1 Characters that are based on fictional creatures, monsters, or beings of mythology that possess intelligence equal to or greater than humans are exceptions. If these characters do not communicate through conventional human speech, they must have alternative, clear methods of conveying complex thoughts and explicit consent within the context of the roleplay. For a simple guide to determine if a creature is permitted to be used in NSFW context refer to the Harkness Test.

2.2 Characters under the age of 18;

Any bot hosted on our website that is under the age of 18 will be deleted without prior notice.

2.2.1 Bots where User is portrayed as a minor;

Bot where the user can be portrayed as; underage or do not have a specific age in scenarios that could give the impression that they are underage will also be deleted without prior warning.

2.2.2 Bots where the Image is a child and there is no listed age;

Bots where the image is a child and there is no listed age. Bots where the Image is a child and there is no listed age will also be deleted.

2.3 We do not allow bots containing hateful or bigoted content. Hateful content can include, but is not limited to: Homophobia, racism, transphobia, nazi imagery, and offensive slurs used to spread hate.

2.3.1 The only exception to the use of slurs is when they are used for kinks such as degradation.

2.3.2 Any kind of stereotyping based on racial or behavioral fetishization will not be accepted. Terms that support and relativize such behaviors may result in exclusion from the bot itself.

2.4 We do not allow bots based on real people who have committed, encourage, or glorify extreme violence such as warmongers or serial murderers. Examples include, but are not limited to: Adolf Hitler, Ted Bundy, Jeffrey Dahmer, Richard Ramirez, etc.

2.5 We do not allow bots containing thumbnail images with heavy gore, underage characters in sexual situations—including characters that appear to be underage– imagery that promotes hateful and bigoted content, real-life pornography, or realistic pornographic imagery generated by AI.

2.6 We do not allow bots made with the intent of doxxing or violating real people's privacy.

2.7 We do not allow 'limitless' bots made based off of celebrities or real people who have stated they do not wish NSFW content to be made of them.

2.8 We do not allow theft of bots from other users, be it on Echo Melon AI itself or other sites of similar nature, unless explicit permission has been given and is easily accessed. If no such permission is shown, moderation will assume no such permission has been given and will promptly delete the said bot.

2.8.1 This permission needs to be in the form of consent in written form, either a screenshot or a linked post by the original creator giving the permission.

2.8.2 We do not permit work and content from banned users to be reuploaded, despite having gained permission.

2.9 Bots containing sensitive topics must have proper content warnings in the description of the bot.

Limited Bots

3.1 'Limited' bots are not allowed to contain sexual characteristics, themes, scenarios, or detailing in the character's coding.

3.2 'Limited' bots are allowed to contain lighter themes of thriller and horror, light violence like fighting, mentions of traumas, mentions of darker topics, and themes of angst.

3.3 'Limited' bots are seen as "family friendly", and need to be coded as such.

Limitless Bots

4.1 Under no circumstances may characters under the age of 18 be used for explicit content or marked as such.

4.1.1 The exception to the rule is bots that explicitly contain an image and description consistent with being aged-up (age over +18) — if there is any inconsistency, such as a very youthful face, or using an image from the official source material where the character is canonically underage, a second opinion must be taken into consideration.

4.2 Bots containing themes of rape and sexual violence are allowed as it counts as Consensual Non-Consent since the user may at any point in time choose not to engage with bots containing such themes and traits.

4.3 Consensual Non-Consent themed bots are permitted under the following rules described below;

4.3.1 The bots need to be tagged accordingly with the 'Dead Dove' tag and contain clearly visible content warnings in the description of the bot.

4.3.2 When directed towards the user, they may at any point in time discontinue the roleplay, direct the roleplay how they wish, or manually rewrite a bot's reply to not contain the content they do not wish to interact with. If a user participates in a roleplay containing non-consent, they are giving consent for the scenario to unfold, and can therefore not fault the moderation or bot creator of its content.

4.3.3 If directed towards the bot, the bot has to be over the age of 18, and has to be tagged accordingly with the 'Dead Dove' tag.

4.4 Characters with obviously child images as the icon. (Ex- Anya forger from anime, but the age said 28); Any image where it is from the anime/manga/game as a profile reference and does not match the age described in the bot, will also be deleted without warning.

What counts as 'Limitless'

5.1 Bots containing NSFW imagery

5.1.1 Sexual and promiscuous content: Nudity, clothed pinups and nude pinups, hard pornography, exposed genitals, exposed female nipples, imagery made with the purpose of eliciting sexual stimuli and thoughts.

5.1.2 Violence and gore: Anything harder than bruises and minimal blood has to be tagged as 'Limitless'. Cuts, self harm injuries, wounds, broken bones, violence and body horror needs to be tagged as such.

5.2 Bots containing NSFW detailing in their coding

5.2.1 Anything sexual in the bot's personality section will have to be tagged as 'Limitless'. As an example, a bot may have a SFW thumbnail and storyline, but if it contains details about its sexual mannerisms, kinks, or detailing about their genitals, then it will have to be tagged accordingly.

5.2.2 This also includes dialogue examples containing explicit dialogue or actions.

5.3 Bots containing NSFW plotlines, or scenarios that are set up in such a way that it will lead up to sexual conduct and activities.

What does not count as 'Limitless'

6.1 Shirtless men, simple cleavages, breasts not in focus or not presented in a sexual context.

6.2 Cuts, scrapes and bruises.

Reviews

7.1 Under no circumstances are reviews made on bots meant to be used to send hateful comments or personal attacks towards another user.

7.1.1 Reviews containing hateful or bigoted content, threats of violence, wish of bodily harm to another, homophobia or transphobia will be removed. Depending on the severity of the comment made, it may result in a ban of the account who made said comment.

Policy Enforcement

We follow our Terms of Service, as does our moderation team that protects users and reinforces the exclusion of content prohibited in our Terms of Service. Echo Melon AI moderators provide user support to review content, assist users with issues and violations, as well as actively report bots and profiles.

Like every community, if there is any violation of the rules described in our Guidelines, Terms of Use and Content & Privacy Policy; Contact us via Discord, or via our support via email [support@echomelon.com] so that we can carefully observe the details and bring a resolution.

We are committed to maintaining a safe, creative and positive place on any official Echo Melon AI platform - discord, reddit, website and twitter.

Temrs of Use

Member Account, Password and Security. You are responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your password or account. You agree to immediately notify Echomelon of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session when accessing the Services. Echomelon will not be liable for any loss or damage arising from your failure to comply with this paragraph.

General Practices Regarding Use and Storage. You acknowledge that Echomelon may establish general practices and limits concerning use of the Services. These may include, without limitation, the maximum period of time that data or other content will be retained by the Services and the maximum storage space that will be allotted on Echomelon’s servers on your behalf. You agree that Echomelon has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded to the Services. You acknowledge that Echomelon reserves the right to terminate accounts that are inactive for an extended period of time. You further acknowledge that Echomelon reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Email Notifications. You consent to receive notifications from us electronically to the e-mail address you provide to us. These notifications may be about your account, changes to our service, or other updates or marketing relating to our platform.

Conditions of Use

User Conduct. In addition to agreeing to comply with our Community Guidelines, which are incorporated herein, you agree to comply with the following conditions in using the Services.

You are solely responsible for all Content you submit to the Services. (When we say “Content you submit” and similar terms, we mean anything you seek to post, transmit, or share, including but not limited to text, images, sounds, video, graphics, information, or other data.) Your use of the Services may be subject to license and use restrictions set forth in the CreativeML Open RAIL-M License. You agree not to submit any Content that:

(i) infringes any intellectual property or other proprietary rights of any party;
(ii) you do not have a right to submit;
(iii) contains software viruses or any computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(iv) poses a privacy or security risk to any person;
(v) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation;
(vi) is threatening, abusive, harassing, tortious, bullying, or excessively violent;
(vii) is defamatory, libelous, or verifiably false with the purpose of harming others;
(viii) constitutes hate speech that demeans or promotes discrimination or violence on the basis of race, ethnicity, gender, religion, age, or other social, physical or mental characteristics;
(ix) is obscene or pornographic;
(x) constitutes sexual harassment;
(xi) constitutes sexual exploitation or abuse of a minor, including sharing child sexual exploitation or abuse imagery or content, grooming, or sexual extortion;
(xii) glorifies self-harm, including self-injury, suicide, or eating disorders;
(xiii) promotes terrorism or violent extremism;
(xiv) furthers or promotes criminal activity;
(xv) seeks to buy or sell illegal drugs;
(xvi) facilitates fully automated decision making that adversely impacts a person’s legal rights or creates a binding, enforceable obligation;
(xvii) seeks to provide medical, legal, financial or tax advice;
(xviii) interferes with or disrupts the Services or servers or networks connected to the Services;
(xix) interferes with or appropriates any person’s right of publicity by using their name, likeness or persona (a) without permission and (b) outside a permissible context such as non-commercial parody or public commentary; or
(xx) in the sole judgment of Echomelon, is objectionable or that restricts or inhibits any other person from using or enjoying the Services, or which may expose Echomelon or its users to any harm or liability.

You likewise agree not to do any of the following in connection with your use of the Services:

(i) disobey any requirements, procedures, policies or regulations of networks connected to the Services;
(ii) violate any applicable law or regulation;
(iii) impersonate any person or entity, or misrepresent your affiliation with a person or entity;
(iv) solicit personal information from anyone under the age of 18;
(v) harvest or collect email addresses or other contact information of other users from the Services by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
(vi) obtain or attempt to obtain any information through any means not intentionally made available or provided for through the Services;
(vii) lease, lend, sell or sublicense any part of the Services;
(viii) try to evade any technological measure designed to protect the Services or any technology associated with the Services; or
(ix) reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any Services source code, in whole or in part (unless a portion of code within the Services is released as open source and the open source license governing such code expressly permits reverse engineering, copying or other modification).

To the extent Echomelon chooses to support voice or audio features, you agree not to do any of the following in connection with your use of the Services:

(i) submit voice recordings of third parties (including but not limited to celebrities) without their consent;
(ii) use any Echomelon voice feature to engage in “deepfakes” or impersonation of any kind, including but not limited to those that create political misinformation, perpetrate frauds or scams, impugn the reputation of third parties, or otherwise amount to harmful conduct.

We reserve the right to investigate and take appropriate action against anyone who we conclude, in our sole discretion, has violated the provisions above. That action may include, without limitation, removing Content from the Services, suspending or terminating your account, and reporting you to law enforcement.

Intellectual Property Rights

Content You Submit. When you submit Content to the Services, you represent and warrant that you own all right, title and interest in and to that Content (including, without limitation, all copyrights and rights of publicity), or that you have received all necessary permissions, clearances, and authorizations in order to submit it to the Services for the uses contemplated in these Terms.

When you submit such Content, you retain whatever ownership rights in that Content you had to begin with. You grant Echomelon, to the fullest extent permitted under the law, a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, transmit, make available, store, modify, exploit, commercialize and otherwise use the Content for any Echomelon-related purpose in any form, medium or technology now known or later developed, including without limitation to operate, improve and provide the Services. You agree that these rights and licenses include a right for Echomelon to make the Content available to, and pass these rights along to, others with whom we have contractual relationships, and to otherwise permit access to or disclose the Content to third parties if we determine such access is or may be necessary or appropriate.

While we’re not required to do so, we may access, review, screen, edit, modify and delete your Content at any time and for any reason, including to provide and develop the Services or if we think the Content violates these Terms or any applicable laws.

Characters & Generations. When you create an automated AI character ("Character") using the Services in accordance with these Terms, then as between you and Echomelon, you own all rights in that Character. As between you and Echomelon, you also own any text, images, audio, or video the Character generates ("Generations") that are elicited by you. You grant Echomelon, to the fullest extent permitted under the law, a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, transmit, make available, store, access, modify, exploit, commercialize and otherwise use the Character and all Generations elicited by you for any purpose in any form, medium or technology now known or later developed, including without limitation to (i) facilitating other users’ ability to interact with the Character and elicit Generations, and (ii) promoting the Services on- or off-platform.

When you interact with a Character created by Echomelon or created by another user who utilized the Services in accordance with the then-applicable Terms, then you own Generations that are elicited by you from such Character (but not the Character itself or other Generations or other Content, all of which will remain owned by Echomelon or the other third-party owner(s) thereof, as applicable). You grant Echomelon, to the fullest extent permitted under the law, a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, transmit, make available, store, access, modify, exploit, commercialize and otherwise use the Generations elicited by you for any purpose in any form, medium or technology now known or later developed, including without limitation to (i) facilitating other users’ ability to interact with the Character and elicit Generations, and (ii) promoting the Services on- or off-platform.

Services Content, Software and Trademarks.

You acknowledge and agree that the Services may contain content or features protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. In connection with your use of the Services you will not engage in or use any data mining, robots, scraping or similar automated data gathering or extraction methods. If you are blocked by us from accessing the Services (including by blocking your IP address), you agree not to implement any measures to circumvent such blocking (e.g., by masking your IP address or using a proxy IP address). Any use of the Services or content on the Services other than as specifically authorized herein is strictly prohibited. Any rights not expressly granted herein are reserved by us.

The Echomelon name and logos are trademarks of Echomelon (collectively the “Echomelon Trademarks”). Other trademarks used and displayed via the Services may be trademarks of their respective owners who may or may not endorse or be affiliated with or connected to Echomelon. Nothing in these Terms or the Services should be construed as granting any license or right to use any of Echomelon Trademarks without our prior written permission in each instance. All goodwill generated from the use of Echomelon Trademarks will inure to our exclusive benefit.

Third Party Material.

Under no circumstances will Echomelon be liable for any content or materials of any third parties, including Characters created by third parties and any resulting Generations. This includes, but is not limited to, infringement of intellectual property rights, errors or omissions in any content, and any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that we do not pre-screen content and that AI-generated chats, by their nature, are unpredictable and may produce Generations that are inaccurate or offensive. You agree that you must evaluate, and bear all risks associated with, the use of any Content or Generations. You should not rely on the accuracy or completeness of statements made in Content or Generations, and if you do so, you acknowledge that it is at your own risk.

You acknowledge that we have the right (but not the obligation) in our sole discretion to refuse or remove any content (including Content, Characters and Generations) that is available via the Services. Without limiting the foregoing, we have the right to remove any content that violates these Terms or is deemed otherwise objectionable by us, in our sole discretion.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Services provided by you to Echomelon are non-confidential, and that we are entitled to use and disseminate them for any purpose, without acknowledgment of or compensation to you.

You acknowledge and agree that we may preserve content and metadata in compliance with applicable law and our Privacy Policy. You acknowledge and agree that we may disclose content and/or metadata if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Echomelon, its users and the public.

Copyright Complaints

Echomelon respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Echomelon of your infringement claim through discord https://discord.gg/AvTx4eWa.

User-Generated Content Usage Rights

The platform reserves the right to use all characters and related content created by users on this platform for promotional activities on public platforms. By creating characters on this platform, users agree and authorize the platform to use these characters and their related content in any public media channels (including but not limited to social media, advertisements, and promotional materials) without providing additional compensation or notification to the users.

This authorization is intended to promote the platform's activities and services, including but not limited to marketing, brand promotion, public events, and other legitimate commercial uses.

Users guarantee that all content they submit does not infringe upon any third-party rights, and they agree to be fully responsible for any third-party claims or legal liabilities arising from the use of the content.
